What “Handling Security Deposits” Means (South Bay / Santa Clara County)
Security deposits can feel tricky. Our job is to make them simple and fair. We follow California law, keep clean records, and explain each step in plain English. This keeps owners protected and helps tenants understand what to expect.
Quick Facts for California Rentals
- How much? For most rentals that start on or after July 1, 2024, the maximum deposit is one month’s rent. Small landlords may be allowed up to two months in limited cases (certain owners with very few units). See the state rules here: California Attorney General – Security Deposits and Civil Code §1950.5.
- 21-day deadline: After move-out, the deposit (or balance) must be returned within 21 calendar days with an itemized list of any deductions.
- Pre-move-out inspection: Tenants can ask for a walkthrough up to two weeks before the tenancy ends so they can fix issues and avoid charges. Learn more: California Courts Self-Help: Security Deposits.
- Allowed deductions: Unpaid rent; cleaning to the same level as move-in; damage beyond normal wear and tear; missing keys/remotes.
- Local note: Some California cities (like San Francisco and Berkeley) require interest on deposits. Most cities in Santa Clara County do not. For San José housing rules, see City of San José – Rent Stabilization.
Our Step-by-Step Deposit Process
- Collect & document at move-in. We collect the deposit, complete a move-in checklist, and capture time-stamped photos/video (Prime tier includes video walkthrough). This sets a clear baseline.
- Hold safely. Funds are kept in our broker’s trust account (Broker: The Property Network, DRE #01166904).
- Mid-term check-ins. Optional checkups help catch small issues early. See our Inspections.
- Pre-move-out help. On request, we offer the legal pre-move-out inspection and a clear punch list so tenants can fix items and reduce deductions.
- Move-out assessment. We compare move-out condition to move-in records. Only actual costs allowed by law are deducted.
- 21-day accounting. Owners see a simple ledger and tenants receive an itemized statement, copies of receipts (when required), and the remaining balance.

Common Owner Questions (Answered Fast)
How much can I collect for a security deposit?
For most new tenancies that start on or after July 1, 2024, California caps the deposit at one month’s rent. Small-landlord exceptions are narrow. Ask us if you qualify; we’ll confirm the details and update your lease.
What counts as “normal wear and tear”?
- Wear: Light carpet traffic, minor nail holes, gentle paint fading.
- Damage: Large wall holes, pet-chewed trim, broken windows, stains from misuse.
We use move-in vs. move-out photos to call this fairly.
Can I charge for cleaning?
Yes—only to return the home to the same level of cleanliness as at move-in. If it was professionally cleaned at move-in, we can deduct for a comparable clean at move-out.
Do I owe deposit interest in San José or Santa Clara County?
Usually no. Some California cities require interest, but most cities in Santa Clara County do not. If you own in a city with an interest rule, we’ll calculate it for you.
What if repairs can’t finish within 21 days?
We send the required itemized statement by day 21. If a repair is still in progress, we provide good-faith estimates and follow with receipts as the law requires.
How We Reduce Disputes
- Clarity up front: Clean lease language and move-in photos reduce “he said/she said.”
- Pre-move-out coaching: Tenants get a simple fix list before leaving.
- Transparent accounting: You see quotes, invoices, and the ledger in real time.
- Fast timelines: Our average vendor response is 1–3 hours for emergencies; standard work orders average 24 hours to schedule.

Simple Scenario (How It Works)
Example: A tenant moves out after two years. The living room has a pet-chewed baseboard and a soda stain on the carpet. The rest is normal wear.
- We compare photos, measure the damage, and pull a vendor quote.
- We deduct only the allowed costs (baseboard patch/paint and spot clean), not normal wear.
- We send you the ledger and send the tenant the itemized statement and the remaining deposit—within 21 days.
